Supreme Court Halts 'Bulldozer Demolitions' Across India Till October 1

The Supreme Court of India has intervened to stop bulldozer demolitions across the country until October 1, unless granted specific permission by the court. This decision was made during the hearing of pleas that raised concerns about properties being demolished under municipal laws in several states, particularly targeting individuals accused of crimes.

The court has clarified that demolitions without permission can only occur on public roads, water bodies, or railway lines. It aims to create guidelines to ensure demolitions are carried out fairly and within the framework of the law, preventing any misuse or violation of constitutional rights.

The Solicitor General, Tushar Mehta, pointed out during the hearing that a misleading narrative was being constructed against these demolitions. He emphasized that the demolitions were not illegal, stating that the government would respond to such claims.

Justice Vishwanathan remarked that the court would examine the justification of bulldozer demolitions in cases of illegal constructions, while ensuring that any actions taken are consistent with municipal laws and constitutional principles. He also highlighted that demolitions for reasons beyond illegal construction cannot be allowed.

The court will reconvene on October 1 to continue addressing the grievances regarding the demolition of properties of individuals accused of crimes. Earlier, the court had questioned the legality of demolishing someone's house simply because they were an accused in a case, stressing that even in cases of conviction, proper legal procedures must be followed.

The petitions, including one filed by Jamiat Ulama-i-Hind, have sought directions to prevent further demolitions related to rioting and violence cases. The Jamiat had previously raised concerns about demolitions in the Jahangirpuri area of Delhi.
