Allahabad High Court sets Sept 3 hearing for Rahul Gandhi's petition against Varanasi court order

The Allahabad High Court has scheduled the next hearing for September 3 on a petition filed by Congress MP Rahul Gandhi. Gandhi is challenging an order from a Varanasi judge who had remanded a matter to the ACJM court, seeking the registration of a First Information Report (FIR) against him.

The request for the FIR stems from a statement Gandhi made in the United States in 2024. During an event in America in September 2024, he allegedly claimed that the environment in India was not favorable for Sikhs, remarks that were later described as "provocative and divisive" and sparked protests.

A Varanasi resident named Nageshwar Mishra had initially filed an application seeking an FIR against Gandhi. However, the Additional Chief Judicial Magistrate (MP-MLA) rejected the application on November 28 of the previous year, citing a lack of jurisdiction since the speech was made outside of India.

Mishra then appealed to a revisional court, which granted his plea and instructed the ACJM to reconsider the case. The court of Special Judge MP/MLA accepted this revision petition on July 21, 2025. Mishra's earlier attempt to have an FIR filed at the Sarnath Police Station in Varanasi was unsuccessful.

In the Allahabad High Court, Gandhi's counsel argued that the Varanasi court's order was "wrong, illegal, and without jurisdiction." The hearing was adjourned by Justice Sameer Jain at the request of Mishra's counsel.
